DSTs & 1031 Exchanges

A 1031 exchange allows an investment property owner to defer paying capital gains tax on the sale of their property by investing the proceeds into a “like-kind” property. Delaware Statutory Trusts (DSTs) are considered “like kind” property. DSTs permit 1031 exchangers to become beneficial owners of professionally managed, institutional-quality real estate projects alongside other accredited investors. Beneficial ownership in a DST provides the investor with the same tax benefits of owning real property.

Qualified Opportunity Zones

The QOZ Program was created to encourage investment in designated communities across the US by providing certain tax incentives in return for committing capital gains into these communities through investment vehicles known as Qualified Opportunity Funds (“QOFs”). The tax incentives include deferral of the capital gain, no capital gains tax on the investment if held for over 10 years, and no depreciation recapture on the investment.
